Legal Issues of Integrating Digital Evidence into the Criminal Procedural Legislation of the Kyrgyz Republic

The main objective of the research was a comprehensive study of the legal nature of digital evidence, their juridical significant features, as well as the formation of recommendations on their implementation in the criminal justice system of the Kyrgyz Republic in accordance with the Cyber Security Strategy.

To achieve this goal, the following tasks were set within the framework of this research:

1.studying the theoretical foundations of the concept and the legal nature of digital evidence, determining the legally significant features of digital evidence and generally recognized standards for their use;

2.analysis of the current criminal procedure legislation and law enforcement practice in criminal cases on the use of digital evidence;

3. studying the features of applying the special knowledge of a specialist and expert to work with digital evidence;

4. consideration of legal issues of integrating digital evidence into the criminal procedural legislation of the Kyrgyz Republic.

Within each of the above tasks, we provided a summary of key findings and conclusions, as well as recommendations for further consideration and implementation. As a practical result of the study, we have developed draft legal documents that are proposed for consideration by the relevant state bodies of the Kyrgyz Republic.

Based on the results of this study, we can state:

  1. Digital evidence is a legal term and characterizes the procedural and legal status of digital information.
  2. Digital information is a form of materialization of a person’s digital footprint in cyberspace.
  3. Digital evidence has a number of legally significant features (digital essence, abstractness, mediation, interpretability, fragility, unlimited copying, variety of forms, cross-border, qualified treatment).
  4. Internationally recognized standards for the use of digital evidence in the justice system include:
  • Ensuring the integrity and authenticity of digital evidence;
  • Documenting the process of working with digital evidence;
  • Support of specialists;
  • Qualification of bodies of inquiry;
  • Legal consistency.

In general, it should be noted that the technical means used in the justice system should serve the principles of individualization and personal nature of criminal liability and punishment (Articles 7 and 8 of the Criminal Code of the Kyrgyz Republic), not restrict a person’s freedom, but assist in proving circumstances of importance for the case, and the administration of justice within a particular case.

The integration of digital evidence into the criminal procedure legislation of the Kyrgyz Republic should be accompanied by the solution of a number of fundamental issues:

  • The Code of Criminal Procedure should define the place of digital evidence in the system of sources of evidence in a criminal case.
  • It is necessary to preserve and, in some cases, expand the effect of constitutional and legal guarantees of the inviolability of privacy in the course of criminal proceedings, including by strengthening the status of the investigating judge in matters of judicial control over the investigation.
  • It is necessary to legally correctly define the legal status, rights and obligations, as well as acceptable ways of communication with digital information providers, including those outside the jurisdiction of Kyrgyzstan.
  • Existing criteria for determining the admissibility of evidence should be supplemented by new criteria that apply exclusively to digital evidence.

Digital evidence can be introduced into the criminal procedure legislation of the Kyrgyz Republic through the adoption of 2 regulatory legal acts:

  • Law on Amendments and Additions to the Code of Criminal Procedure of the Kyrgyz Republic (creates a legal framework for the use of digital evidence)
  • Rules for the collection, seizure, storage and evaluation of digital evidence (govern the step-by-step actions of the persons involved in the collection, storage and examination of digital evidence).

LoraWan IoT Data Dashboard

The team created beta version of the dashboard visualization of the project data collected from pilot locations.

The dashboard represents visualization of the following data: relative air humidity, air temperature, solar irradiation, atmospheric pressure, precipitation, wind speed, wind direction. The other dashboard represents visualization of the following data: soil moisture and precipitation, water level. Dashboards are available in Kyrgyz, English and Russian languages. Some dashboards are specially designed for local communities to use for the benefit of community.

We believe in open source solutions. That’s why we use Grafana – a multi-platform open source analytics and interactive visualization web application.The information gathered from Lora-enabled sensors through Lorawan communication gateways and transmitted to the central server via GSM network. Collected IoT telemetry data stored on servers and then visualized using Grafana software. Up-to date information is available via link: http://dashboard.isoc.kg

About the project Sanarip Insan.

The project “Promotion of Equal Economic Opportunities and Youth Sustainability” (hereinafter referred to as Sanarip Insan) is implemented by the Public Association “Internet Society Кyrgyz Chapter” with the support of the European Union Representation in the Kyrgyz Republic.

Sanarip Insan aims to develop knowledge and skills in the field of digital and green economy among youth and women residing in rural areas. The project involves conducting informational events to enhance digital literacy in collaboration with mass media and social networks, as well as adapting and developing educational materials in partnership with representatives from the education sector. It also includes organizing joint initiatives with stakeholders and government bodies to educate youth about working on digital platforms such as e-government, e-commerce, and digital economy. The long-term goals of the project are to improve the indicators of youth well-being in line with the Sustainable Development Goals 2030.

As part of the project, training has been conducted in all regions of the country. Training on digital tourism and e-commerce were organized in 10 densely populated districts of Kyrgyzstan, with the participation of young people, women, and entrepreneurs from the tourism and commerce sectors.

The training lasted for 2 days, during which participants enhanced their basic digital skills and knowledge using the MISTT (Mobile Internet Skills Training Toolkit) methodology for working on digital tourism platforms and effectively using social media platforms such as Instagram, TikTok, and Facebook. They also learned how to register and use Google My Business, messaging apps like WhatsApp and Telegram, Google Maps and 2GIS, and booking platforms such as Booking.com, Airbnb, Expedia, Agoda, Bronevik.com. They also received insights on review websites like TripAdvisor.com, Shelter PMS, Edelweiss, Fidelio, and WebPMS Traveline, as well as systems for hotel management automation. At the end of the training, participants were awarded certificates.

During the “E-commerce” training? participants acquired the following skills:

  • Presenting products or services using photos, videos and text in accordance with modern market requirements.
  • Creating textual descriptions.
  • Learning the secrets of writing and copywriting texts for advertisements, posts, articles and technical assignments.
  • Practicing mobile photography (mobilography).
  • Mastering the secrets of shooting, editing and posting content on electronic platforms using relevant applications.

Based on the above, the Internet Society Kyrgyz Chapter announces a competition among interested organizations/expert groups to provide services for the production of video clips showcasing success stories of project beneficiaries.

For a video production service provider:

The video shoot will take place at locations proposed by the Client. The video shoot should involve the work of videographer, lighting technician and director. All shooting and lighting equipment will be provided by the Service Provider.

The plan includes shooting a hero video. The total number of videos is 8 (7 success story videos and 1 overall overview). The duration of each video should range from 3 minutes to 5 minutes.

The editing process may involve assembling the captured footage and editing according to the approved script. A rough video edit should be presented to the Client for approval. Any feedback or suggestions from the Client should be incorporated, which may involve adjustments to the video sequence. A final video edit is done based on the Client’s feedback. The video clip is then provided to the Client for final approval.

Description of the scope of work:

  • Preparation for the shoot; 
  • Filming process (organizing the shoot with professional equipment at approved locations); 
  • Multimedia post-production (visual effects, graphic design, digitization and processing of raw footage, video editing, color correction, sound design, insertion of animations and other components); Delivery of the final materials on a portable storage device or via cloud storage.

Expected outcomes:

The technical specifications should be completed between June 25 and August 25, 2023. The delivery deadlines for the products will be discussed between Aisok and the selected Service Provider upon contract agreement. The Service Provider should seek client approval for the project deliverables at each stage. Please refer to Appendix 1 for examples of materials.

Key characteristics of the deliverable include:

  • high quality video sequences;
  • dynamic video with elements of storytelling;
  • key message transmission;
  • subtitled in Russian and English.

Products:

  • Three language versions of the main final video (with Kyrgyz original, version with Russian and English subtitles) lasting from 3 to 5 minutes in dynamic video format using infographics.
  • Three language versions of the overview video (with Kyrgyz original, version with subtitles in Russian and English) lasting from 10 to 15 minutes in the format of a dynamic video with the use of infographics.
  • Videos adapted for social networks (Instagram, Facebook, TikTok).
  • Treated photos.
  • All source files.

Requirements for video material:

  • The contractor shall ensure the creation of a visual design with graphic elements, infographics and animations, a final splash screen with all logos. The design of the graphic elements must comply with the parameters described in the handbook on graphic requirements;
  • The contractor must provide professional high quality transitions, high quality sound, Kyrgyz language voiceover and appropriate background music in the video. The contractor provides background music in compliance with copyrights;
  • The Contractor is to submit the preliminary result for review and approval by the Client on 25 August 2023 and the final version on 5 September 2023.
  • Once the contract has been signed, the scope of work includes:
    • Meeting with the Sanarip Insan project team to discuss the video script and shooting schedule
    • Preparation of the script/scenario and getting approval from the project
    • Shooting in Osh, Jalalabad, Chui, Naryn, Issyk-Kul, Talas and Batken oblasts (one shoot in each location)
    • Production of the first version of the video, receiving feedback from the project
    • Production of the final versions
    • Submission of the final version with subtitles.

Transfer of result: 

The Contractor will provide the final Full HD version of the video production (all video footage) and the entire archive of video and sound files on hard disk. The Contractor will also place the files on a file-sharing service and provide the Client with a link to download the file. When materials are transferred all rights (use and distribution) of ownership are transferred to Sanarip Insan Project in the Kyrgyz Republic.

All materials developed under this Assignment are the property of the Sanarip Insan project and may be transferred to third parties only by agreement with the project.

Location of implementation – all regions of Kyrgyzstan

Accountability and coordination

In the execution of this assignment, the Consultant shall report to the Project Coordinator, Sanarip Insan. The Consultant shall keep the Coordinator informed of the progress of the assignment and of any difficulties encountered in the execution of the work.

Form of contract

The preferred form of the contract is a civil law contract for the provision of services, which requires the applicant to be registered as a legal entity or sole proprietorship.

Terms of payment

Payment for services rendered will be made upon production of the video clips and upon inspection thereof on the basis of the invoice issued and the Acceptance Certificate for services rendered by bank transfer by bank transfer to the Contractor’s current account specified in the payment invoice. All tax and social charges under this assignment will be included in the contract amount and are the responsibility of the Contractor and the submission of an “Electronic Invoice” (EIB) to the Tax Office. Reporting information will be provided additionally.

Internet Society Kyrgyzstan Chapter commits to mainstreaming digital skills of youth in the Kyrgyz Republic

Internet Society Kyrgyzstan Chapter is a non-profit organization founded in 2015 to support the development of the Internet as a global technical infrastructure, a resource to enrich people’s lives, and a force for good in society.

The organization helps to create community internet networks in remote mountainous areas of the country, develops edu-tech solutions to help youth access decent education, and conducts regular training for youth, women, and involved stakeholders to fulfill their mission.

Internet Society Kyrgyzstan Chapter’s commitment falls under its Sanarip Insan (Digital Citizen) project, which aims to empower women and youth in rural communities of the Kyrgyz Republic by improving their digital skills and increasing their employability in the green economy. Young people in rural areas will receive regional training on developing technical and vocational skills, ICT ,and soft skills.

In total 100, 000 young men and women between the ages of 15-29 residing in rural areas and young people with low levels of education and/or drop-outs will be benefited. The commitment will equip the youth with digital skills and basic digital literacy by March 2024. The project is funded by the European Union and implemented in partnership with the European Neighbourhood Council (Belgium).

In practice, the project will run entrepreneurship programs that combine different types of skills training – including “hard” and “soft” skills – with support services such as coaching and mentoring. The main scope of work is built on the following activities: Media campaigns with the involvement of local bloggers and popular social media media, digital literacy, and green skills development, ways to launch creative start-ups, methods to foster e-business models with small budgets and tips for raising initial capital through online and in-person training in different stages by digital leaders and experts.

Young women will be encouraged to engage and benefit from the digital economy through knowledge in e-commerce, digital tourism, e-agriculture, or e-business.

Internet Society Kyrgyzstan Chapter will contribute to the UN Sustainable Development Goals SDG5 (Gender Equality) and SDG8 (Decent work and economic growth).

Так как большая часть населения в сельской местности Кыргызстана занимается животноводством и сельским хозяйством, страна пополняет ряды аграрных стран. Около 40 процентов рабочей силы занято в сельском хозяйстве, что составляет 20 процентов валового внутреннего продукта. В связи с этим на очередном вебинаре мы поговорим о цифровом сельском хозяйстве. Цифровизация – ключевой вектор развития страны, в том числе и сельского хозяйства.

Современная сельскохозяйственная революция включает внедрение передовых информационных технологий (ИТ), которые сокращают объем ручного труда и затраты при одновременном повышении производительности и урожайности. На сегодняшний день современные технологии в сельском хозяйстве это не только компьютеры. Цифровые технологии позволяют отслеживать полный цикл выращивания растений или животноводства – “умные” устройства измеряют и передают параметры почвы, растительности, микроклимата. Мобильные или онлайн-приложения позволяют фермерам и агрономам определять удобное время для посадки или сбора урожая сельскохозяйственных культур, рассчитывать схему удобрений, прогнозировать урожай. 

ISOC Kyrgyz Chapter and the Institute of Water Problems Collaborate for High Mountain Glacier Lake Monitoring

19 мая 2023 года Кыргызское отделение Интернет-общества (ISOC) провело встречу с Институтом водных проблем Академии наук Кыргызской Республики. Обсуждение вращалось вокруг текущего состояния мониторинга высокогорных ледниковых озер, потенциальных преимуществ проекта ISOC для кыргызских ученых и предстоящих планов по установке датчиков.

Мониторинг высокогорных ледниковых озер имеет огромное значение, учитывая их значительную роль в поддержании местного и регионального водного баланса. Однако такие проблемы, как удаленность, суровые условия окружающей среды и технические ограничения, часто затрудняют комплексный мониторинг. В ходе встречи представители кыргызского отделения ISOC представили свой текущий исследовательский проект, направленный на преодоление этих препятствий за счет инновационного использования технологий.

В рамках проекта исследовательских грантов, финансируемого Фондом ISOC, кыргызское отделение ISOC планирует установить метеорологические станции, датчики измерения уровня снега и воды на ледниковом озере Адыгене и прилегающих моренах. В этом проекте будут использоваться передовые датчики с поддержкой Lorawan для предоставления данных в режиме реального времени о различных параметрах окружающей среды. С помощью этой инициативы Отделение стремится поддержать существующие усилия по мониторингу, предоставляя надежный и последовательный поток данных, который может помочь ученым в понимании и более точном прогнозировании поведения ледников.

Участники встречи обсудили возможные даты установки датчиков, сузив их до периода с июня по июль 2023 года. Этот график согласуется с оптимальными погодными условиями для таких операций, что обеспечивает более безопасные и эффективные процедуры установки.

Институт водных проблем, ведущий орган по исследованиям в области водных ресурсов в Кыргызстане, выразил высокую поддержку исследовательской работе кыргызского отделения ISOC. Институт высоко оценил технический подход к решению задач мониторинга ледников и выразил оптимизм по поводу положительных результатов этого исследовательского проекта. Сотрудничество знаменует собой значительный шаг к обогащению научного ландшафта Кыргызстана за счет сочетания традиционных полевых исследований с передовыми технологиями.

По мере реализации проекта он будет способствовать более глубокому пониманию динамики ледниковых озер. Что еще более важно, он предоставит полезную информацию для управления водными ресурсами, прогнозирования бедствий и усилий по смягчению последствий изменения климата, тем самым подчеркнув преобразующую роль технологий в сохранении окружающей среды.

“Tech4Society project participates in international conference “Digital resilience program”

On May 18th, an international conference on “Digital Resilience Program: Completion and Next Steps” took place at the Kyrgyz State Technical University named after I. Razzakov.

The conference was attended by the Deputy Minister of Digital Development of the Kyrgyz Republic, Indira Sharshenova, the Head of the World Bank’s Office in the Kyrgyz Republic, Navid Hassan Nawki, as well as international organizations and experts in the field of digital technologies.

Also presenting at this event was the cybersecurity expert from the Tech4Society team, Nurbek Arzymbaev. In his speech, he emphasized the importance of developing national cybersecurity standards based on advanced international experience.
