Research on Personal Data in the Commercial Sector of the Kyrgyz Republic

The main objective of the study was to find out how the “market”, the commercial[1] sector in the Kyrgyz Republic enforces the legislation in the collection and processing of personal data directly provided by the users[2], in the absence of an enforcement authority.

According to the results of our research, we can state that the vast majority of companies we studied collect personal data illegitimately, do not inform users about the list of collected personal data, the purposes of their collection and processing, their rights, storage periods and their protection.

Of the more than 500 company websites we reviewed, about 180 directly collect personal data (hereinafter referred to as PD) from users. The vast majority collect users’ contact details to provide feedback and send information about company promotions and products.

 Out of 180 companies collecting personal data, only 44 companies obtain consent. However, according to our research, the absolute majority of online consent forms for personal data processing do not comply with the personal data legislation of the Kyrgyz Republic. According to the current legislation, there are no norms for giving electronic consent to the collection and processing of personal data, except for the use of electronic signature. Despite the fact that the law has a more simplified form – “simple electronic signature”, of the number of web resources reviewed, only a few web resources use it to obtain consent to the collection and processing of personal data.

Of the 180 websites that requested a PD, over 40% of the websites were located outside the country. However, only six companies displayed cross-border data transfer clauses in the consent form.

Of the 519 websites, only 17 (or 3%) had published a Personal Data Processing Policy on their websites[3]. Accordingly, they do not familiarise users with the purposes of collecting PD, conditions of processing, storage, destruction, rights and other important aspects related to PD. It should also be noted that only one company out of 519 has developed and published its Data Processing Policy in Kyrgyz.

It is rather difficult to make unambiguous conclusions about the volume and excessiveness of collected data due to the lack of collection purposes published by the companies. However, we have recorded cases of collecting special categories of personal data[4] and collection of personal data that do not correspond to the text of the consents obtained.

In general, we can draw a portrait of companies in the commercial sector – the company collects personal data directly from users only for marketing mailings, feedback or discounts; does not obtain legitimate consent from users for the collection and processing of personal data; does not notify users about the measures taken to protect personal data, about the rights of users.

According to the results of the study, it can be concluded that the absence of an authorised body negatively affects the relationship of the subject of PD with the private sector. PD subjects cannot realise their legal rights, the commercial sector does not actually comply with the legislation and other acts on personal data protection in the country. Also during the research, having studied the legislation of the country, having checked the enforcement of the rights of the PD subjects, having analysed the leakage of PD, we believe that there are significant gaps in the legislation of the country. For example, the main ones include the following: the rights to revoke consent are not clearly defined, there are difficulties in giving electronic consent (only electronic signature), there are no norms on notification of leakage, the possibility of unsubscribing from marketing mailings and protection of children’s personal data, etc. [1]The issue of data collection and processing is a matter of data collection and processing.

1) Maintaining accounting and financial records, including:

a)      Maintaining books and records of financial assets, inventory management, and operating cost accounting;

b)     Tracking financial flows in accordance with the policies and procedures of international counterparts;

c)      Preparation of funding request forms and financial plans in accordance with the office budget;

d)     Transfer of taxes and other payments and fees to the relevant state organizations;

e)      Payroll management, including control of Staff’s vacation and sick days;

f)       Making payment of salaries to employees and other payments;

g)      Preparation of monthly and other reports in accordance with established forms;

h)     Perform other accounting-related duties upon the request of ISOC Project Managers;

i)       Ensure all data is correctly entered in 1C;

j)       Preparation and submission of required accounting reports to the Tax Department, Social Fund and Statistics Department.

2) Preparation required documents requested by external auditors as well as for due diligence procedures;

3) Preparation of necessary documents for the procurement of goods and services for office needs;

4) Assistance with making payments and writing expense reports when ISOC Kyrgyz Chapter Projects’ conducts events (seminars, trainings, conferences, and other events);

5) Documentation and inventory of equipment purchases;

Internet Society Kyrgyz Chapter is announcing Competition for the provision of services of the Project Coordinator

Background

With the financial support of the European Commission European Neighborhood Council in partnership with the Internet Society Kyrgyz Chapter Public Association is planning to implement a 30 month project “Promotion of equal economic opportunities and youth resilience” in Kyrgyz Republic.

The aim of the project is to provide knowledge of the work of the digital and green economy to young people and women living in rural regions of the Kyrgyz Republic. This project provides for holding information events to increase the level of digital literacy in cooperation with the media and social networks, adapting and developing educational and methodological materials with representatives of the education sector, as well as conducting joint initiatives with representatives of the digital economy and government agencies to train young people to work in digital platforms in the e-government, e-commerce and digital economy sectors.

Objective

The Project Coordinator will manage and coordinate project leading and implementation, team coordination, consultation and engagement with all relevant internal and external stakeholders. Project Coordinator is expected to provide expertise on the state of digital literacy, startup ecosystem, stakeholder cooperation.

Internet Society Kyrgyzstan Chapter is a nonprofit organization founded in Bishkek in 2016 to bring better Internet connectivity to Kyrgyz Republic. The objective of ISOC HQ and local chapter dedicated to building “Healthy Internet for Future Generations”. The main features of the ilimbox platform

The Covid-19 pandemic has exposed shortcomings in the Kyrgyz education system and many problems have arisen. All schoolchildren and students had to study at home in the form of distance learning. With distance learning, the following problems arose:

  • Lack of training materials required for online learning, lack of available mobile phone materials and large file sizes;
  • Difficulty using online learning tools;
  • In some places, Internet access was poor and not available;
  • Lack of materials in Kyrgyz (60% of Kyrgyz-taught schools in Kyrgyzstan)
  • There are no materials that encourage students to study online and there is no platform for feedback between teacher and student;

There were problems with the lack of structuring of the teaching materials available (such as online video tutorials, tests, etc.).

Even before the pandemic, the Internet Society Kyrgyzstan Chapter had done a lot of important work in the field of education. At the moment, the ilimbox project, a digital source of knowledge, has been successfully implemented, the digital device has been placed in areas where there is no Internet connection.

The Kyrgyz Internet Society is working to address these issues, to develop an accessible educational platform that would regulate distance learning, increase the volume and consolidation of Kyrgyz language materials, provide feedback between teachers and students, and monitor student learning.

Currently, the ilimbox educational platform has been developed.

The ilimbox team has developed a system taking into account all the problems that arise during online training, and has the following advantages:

  • All video tutorials and educational materials are adapted for mobile phones, tablets and computers.
  • Calendar integration, reminders, return to recent reading, and more.
  • Interesting tests and fun interactive tasks.
  • For students not attending a temporary school, this is an opportunity to continue their studies without going beyond the curriculum.
  • Providing teachers with digital multimedia materials on subjects.
  • A training tool available during a pandemic and all training materials in one place.

The ilimbox team took into account all the news and developed an open educational platform.

Registration and use of the platform has been simplified. Users can register using their mobile phone number and email.

The file size and quality of video tutorials have been reduced without loss of quality, which in turn allows you to use a low-speed Internet connection and save bandwidth. For example, if the file size of the book was originally 600 MB, on our platform it is 20 MB.

If the video tutorials are 300 MB on the YouTube platform, the ilimbox educational platform is only 30 MB and without any loss of quality.

This, in turn, gives great advantages to our schoolchildren, you can open at a low Internet speed and save Internet traffic.

Schoolchildren can easily watch video lessons and learn on the ilimbox platform without worrying about the speed and traffic of the Internet, because in our system all materials are compressed tens and even hundreds of times.

Why was it important to us?

Firstly, in our country there are places where the speed of the Internet connection is very weak, the file size is very important for such regions. Educational material (video tutorials, books, etc.) of small size and without loss of quality – this makes it comfortable to use the platform.

Secondly, schoolchildren can save Internet traffic, for example, if they watch one video lesson on YouTube, they can spend an average of 300 MB, and on the ilimbox platform they can watch video lessons, solve interactive problems and tests for 30 MB, and for the remaining Internet traffic can be spent on viewing other educational materials. The ilimbox team does not want to be satisfied with what has already been achieved, the future plans of the team are to fill it with interesting educational materials, prepare and post short videos of experiments in physics, chemistry and natural science for high school students in the Kyrgyz language. ilimbox – Source of digital knowledge. Benefits, what features and for whom, as well as reducing file size.

How did you get involved with the Ilimbox project?

I joined the Ilimbox project for many reasons and a long time ago. In 2016-2017, at the Kyrgyz-Turkish University Manas, on the initiative of Erzhigit Imamov, with the support of the university and the head of the Department of Computer Engineering of KTMU Assoc. Doc. Raimbek Sultanov started a project called “Development of a distance learning system on simple platforms by compressing audio and video files.” In the course of this project, we studied algorithms for compressing audio / video files and chose the most optimal formats, encoding several video files in different formats, i.e. small in size but with good visual quality. This, in turn, created a good opportunity to save internet traffic and at the same time allowed the student who wants to watch the video lesson with good visual quality.

As a continuation of this project, the Ilimbox project was implemented in the Kyrgyz Internet Society, but I did not participate in this project. A pandemic began, schoolchildren and students went into the online format of education, and the same problems appeared for schoolchildren. The Kyrgyz Internet Society took up these problems and started the project “ilimbox.kg – online bilim berүү platformas” and I was very glad to know that this is a continuation of the work that we started.

How important is the creation of Edutech projects at the moment?

The creation of such projects is now very important, or rather, it was not important before, but now, during the pandemic caused by the spread of the Covid-19 virus, all training takes place online. In this context, these technologies create a good learning and teaching environment. At the beginning of the project, our idea was that schoolchildren in remote areas should receive no less education than in the capital, but I think I am right in saying that the problems that teachers and students face during a pandemic highlight the importance of Edutech projects.

What do students really want to know and learn?

I think the most important thing is for young people of every generation to think about how to use the knowledge gained in life, in the process of their future work.

For example, how are trigonometric functions and equations studied in mathematics used in practice and this question can be of great concern to many people, but these equations are often used everywhere. For example, in construction, robotics, electronics, mechanical engineering.

I think the same can be said for children who say that they don’t need too much information and that they want to know more. Therefore, it would be good to teach them to apply every piece of knowledge. In general, today the demand is for our children to want to become programmers, designers, architects, businessmen. In other words, the question arises: “What do young people really need to know and read?” If so, then I would advise “the masters of our future, for young people today – to learn how to find accurate and timely information.”

What motivates you to do these things? (motivation)

The most important thing is that our youth can receive unlimited education anytime and anywhere. We now have phones, tablets and other electronic media. These media should also be in the Kyrgyz language, in the Kyrgyz language, firstly, it is good for us as a nation, and secondly, it creates conditions for people who want to know our nation and country. I also think that it is important for the children of our migrants abroad, if you are abroad, there is no school with Kyrgyz as the language of instruction, but you can study online on the educational platform. I hope the work we are doing in this direction will bring good results in the future.

Benefits of Distance Learning?

We’ve already talked a little about the benefits of distance learning. Let’s look at them again:

  • Access to education for schoolchildren and students living in remote areas, on a par with schoolchildren and students in the capital.
  • Convenience for students with disabilities.
  • Reduce the teacher shortage to some extent.
  • Availability of teaching aids.
  • Ability to save recurring lessons as a video lesson and watch it again at any time.

What are the problems with distance learning?

During the pandemic, both teachers and students faced many distance learning challenges that started suddenly.

Such as:

  • Lack of information and technical base. This problem has caused economic damage to parents and teachers. More importantly, there is no educational material and information in the Kyrgyz language. I believe that the Ilimbox project correctly and accurately solved this problem, online lessons on our platform in the Kyrgyz language, video lessons prepared by the Ministry of Education and Science of the Kyrgyz Republic are available.
  • Lack of distance learning experience. I think this problem was solved by itself. Today, many of our teachers have done a great job in distance learning and have gained good experience.
  • Lack of information and communication skills of schoolchildren and teachers. This problem was also gradually resolved and, as noted above, it was a great experience for all of us. We have mastered the use of smartphones in education and training, which we previously only used for talking, taking photos, listening to music or playing games.

What are the main technical advantages of the ilimbox platform?

The main technical advantage of the Ilimbox platform is the ability to use it in all corners of Kyrgyzstan where there is Internet. The right to download lessons and video lessons, this is due to the fact that all videos were prepared by the Ministry of Education and Science, and the text and additional materials were prepared by practicing teachers. I think we have organized these materials in such a way that they are simple and understandable for students. In addition, interactive assignments and tests have been added to make the lessons more interesting.

What opportunities does the platform open to users?

The platform offers users a variety of options. A teacher using the platform can collect and use the learning materials he or she has prepared for students at any time. If the teacher has mastered the creation of educational materials on the portal, then in the future he can create his own full-fledged author’s training program and, if desired, open courses for schoolchildren / students.

Offers much more opportunities for pupils / students. Even if the online lessons are over and the offline lessons have started, you can still use the Ilimbox platform. Review the lesson if he missed it, let him repeat the topic he missed in the lesson and let him complete it if he wants to learn more. Most importantly, children from remote areas can read what they read in the capital or other major cities.

As mentioned above for a teacher, if a teacher creates their own authoring course and posts it on the platform, they can learn from an experienced teacher.

In addition, if you are interested, you can learn what the Kyrgyz language is in any lesson depending on the topic. For example, I am a schoolboy and I study in a Russian-speaking class, we have learned a subject in Russian and understood it well, but my sister or brother is studying in a Kyrgyz class, and a year later my brother was poorly versed in the subject in the class and when I start to explain -Russian, my brother is dizzy again, I think that if I sit down with my brother and look at these materials, it will help explain in other words, parents have the opportunity to explain to their children what they do not understand.

Why is all information on the platform on servers located in Kyrgyzstan?

In general, the location on servers inside Kyrgyzstan is an advantage in all respects, since the users of this platform are Kyrgyzstan, the materials created in Kyrgyzstan must be located on our own servers (from a security point of view).

This is partly due to traffic, as you know, many internet providers divide internet traffic into Kyrgyzstan and abroad, and because of this, external internet traffic is a little slower.

How are video tutorials located on the Ilimbox educational platform?

In fact, most of my work on the project was related to video materials, from March to mid-June of this year we collected, sorted, copied and encoded videos and, by the decision of the team, I took on this work. In total, the ministry prepared an average of 80-100 video lessons, depending on the topic of each lesson. We are introducing curricula for grades 8-9-10 and in the 8th grade 283 subjects, in the 9th – 267, in the 10th – 264 and the same number of video lessons.

If one person speaks for 20 minutes while discussing a topic, the other person may get tired and distracted. With this in mind, our team decided to divide the videos into sections according to their meaning, this is because a short video is a convenient way to find a part of a topic and listen to it again. Of course, the student could skip the video time and start from the right place, however, we believe that it is more convenient for both the teacher and the student to divide it into logically correct parts.

How important is it to reduce the file size of video tutorials?

The Ministry of Education and Science has given permission to their ftp server, to which we have uploaded a total of 972 videos, including the 7th grade. The average viewing time of these videos is 20 minutes and the average size is 300-500 MB, and the format is the well-known MP4 video format. As a result of encoding, the same files were 25-40 MB in size. This means that it took up almost 10 times less space. However, not all videos on the ministry’s file server were 300-500 MB in size, but 1.5-2 GB. However, the size of these large videos has been reduced to another 20-50 MB.

These videos average 20 minutes of video.

Perhaps, now such a question arises here, if the file size is reduced by 10 times, then the quality is reduced by another 10 times. No. Although this encoding method has been developed for a long time, it is newer than the encoding method provided by the MP4 format and uses different algorithms. Simply put, the video we are watching consists of parts (pixels) that have been stationary and moving for a while. We can say that the algorithm of the new codec captures the fixed parts of the video separately from the moving parts. The background of the speaking person, the text during the presentation, etc., while the moving parts are the teacher’s speech, the cursor, the moving text, etc. The background behind the teacher’s explanation is saved only once, and the moving teacher is present in all frames of the video, and the background is copied from the original frames.

If you look at this image, there is no car in the 1st frame, and when the car passes by, you can see the full picture when you show the car along with the background in the 1st frame.

If we take this second image, the car will be stationary relative to the camera because it is moving, but the background is moving (changing).

We used this codec to compress video. How much time was spent coding? 5-8 videos were encoded in 24 hours, which took 3 to 5 hours for each video. We shot the aforementioned 972 videos in March, April and May using 6 computers in our office, for a total of over a thousand videos.

How do you see the project in a few years?

I hope that in a few years the project will reach a higher level, that teachers will fully master the use of this platform, and that students (content specialists) who have worked as content creators in our country will become teachers in the future, will take full advantage of this platform and undertake new steps in teaching your students. I hope that the teaching materials will be enriched, enriched for students as well.

We started working with teachers from Issyk-Kul oblast.

In April, we announced a competition for teachers in the Issyk-Kul region in the ilimbox food project to fill content into the educational portal. More than 90 teachers submitted applications, 52 passed to the second round, and the ilimbox team selected 12 teachers for further work and held a seminar on digital skills.

The ilimbox team introduced teachers to Google programs, online communication and other digital applications. They also learned to work remotely, since in the future all work will be organized remotely.

They have mastered email, created a lesson template in Google Doc, save files to Google Drive, and communicate with the team remotely.

Participants gained experience in image search, reducing file sizes without losing quality, finding the right information and content for schoolchildren, structuring materials and search engine optimization.

Teachers from Issyk-Kul oblast selected to participate in the ilimbox training course creation subproject

The ilimbox team launches a sub-project for filling with content, the purpose of the sub-project is to fill the educational platform ilimbox with educational materials in the Kyrgyz language.

Within the framework of the project, the ilimbox team announced a competition for practicing teachers. Teachers need to develop methods for converting offline lessons to online formats. Developing reinforcement tests in accordance with established standards, enriching the learning content with additional educational resources and making proposals for improving access to educational materials.

The teachers were selected taking into account the following requirements:

Residents of the Issyk-Kul region, work experience of 7 or more years, has a personal computer and basic digital skills.

More than 90 applications were submitted to the registration form, of which the team selected 52, conducted interviews and received the following information.

11-12% of teachers were transferred to each subject and on average to each subject.

94% said they have a laptop or computer and can work with digital programs.

During distance learning, teachers often began to conduct online lessons on various platforms and we asked the teachers we interviewed about this because it is very important in online learning.

The teachers were asked the following question with some answers: “Have you ever taught an online lesson? What should be an online course? How did you do it (presentation, video, text) “

During the pandemic, teachers who spoke to us reported that 56% of lessons were conducted online with slides (presentations), 63% with finished videos and text, WhatsApp and email attachments, as seen in the following diagram.

However, there were few users who used and worked with other educational platforms and online communications.

Only 45% said they can use Google software, and 66% said they can only use email.

They answered that they often use Zoom and Google Meet for online communication, this is somewhere between 40-86%.

The ilimbox team plans to hold a digital literacy workshop, selecting 12 teachers and continue to work on filling out the content.
